The West Virginia money transmitter license guide (Faisal Khan LLC, July 2026) is built on the enacted statute — W. Va. Code § 32A-2-1 et seq. — rather than the regulator's website, which the guide says is years out of date on several points.

The bond alone catches most applicants out: it is a flat amount by activity type, not a volume ladder — $300,000 for wire/electronic transmission or currency transportation, $100,000 for checks, money orders or currency exchange. No cash or securities may be deposited in lieu, an option the WV Division of Financial Institutions' own site still wrongly advertises. Tangible net worth was rewritten by Senate Bill 505 (2022), repealing the old "$50,000 + $25,000 per delegate location" rule in favor of the standard 3%/2%/0.5% bands — but capped at $1,000,000, a major deviation from the model act that a $1bn-asset licensee would otherwise clear at roughly $21M.

  • Application fee $1,000 + $20 per location, capped at $25,000, and a statutory 120-day decision clock with no deemed approval
  • The § 32A-2-3 exemption list — closed and short, with no carve-out for broker-dealers, insurers, attorneys or title companies
  • Scope reaching payroll processing, digital wallets, crypto exchange, virtual currency storage and kiosks, with check cashing licensed separately
  • The 2022 like-kind holding rule requiring licensees to hold virtual currency matching customer obligations
  • HB 5353 (signed April 2026), bringing virtual currency kiosks into licensure with daily transaction caps and a 15% fee ceiling
  • Year-one and annual cost tables across three licensee sizes

The strategic read: the $1M net worth cap and 120-day clock make West Virginia comparatively friendly; the $300,000 bond, mandatory audits and volume-based renewal assessment do not.
