United States Money Transmitter Licensing

The United States has no single, nationwide money transmitter license. Unlike most countries on this index, where one national regulator issues one authorisation, the U.S. splits the job across two levels of government — and the level that actually lets you move customer money is the states, not Washington.

Federal registration vs. state licensing

At the federal level, a money services business (MSB) registers with FinCEN and operates under the Bank Secrecy Act — maintaining an AML programme, filing suspicious-activity and currency-transaction reports, and renewing its registration every two years. But that registration is not a licence to transmit. The authority to accept funds from one person and pay them out to another is granted state by state, by each state's banking or financial-services regulator.

What operating nationwide actually requires

A company that wants to serve the whole country needs a separate money transmitter license in nearly every state it touches — roughly 50 approvals across the 50 states, the District of Columbia, and the U.S. territories. Each jurisdiction sets its own rules: a distinct regulator, application and investigation fees, a surety bond (often scaling with volume), a minimum tangible net-worth requirement, permissible-investment rules to safeguard customer funds, and background checks on owners and control persons. Most states file through the NMLS multistate system, but timelines vary widely — some clear an application in weeks, others take the better part of a year.
