Uniswap and other DeFi apps operate without money transmitter licenses. Why can’t we do the same?

Because a true DEX never triggers the definition, and this model triggers it at every point. DEX contracts are immutable, with no function the company can call on user funds. Liquidity belongs to independent third parties. The user signs, broadcasts, and pays gas for every transaction personally, in one atomic step. And fiat never touches the system — on-ramps and off-ramps go to licensed partners. That is why no US money transmission case has ever been brought against a true DEX; the federal actions Uniswap Labs faced were about products and securities theories, and the securities investigation closed with no action. The dividing line in the case law is the relayer: the moment an operator broadcasts transactions on users’ behalf, manages fees, and profits from the flow, prosecutors treat it as operating a transmission service. A platform that also holds the lock-and-payout trigger sits past those defendants, not next to Uniswap.
